Bagi rekan-rekan yang ingin mengetahui secara singkat sistem tender di Proyek2 Loan ADB, berikut ini ada sedikit artikel mengenai pengkategorian Tender berdasarkan prosedur penyampaian dokumen tendernya:
Bidding Procedures ADB Loan Project
In principle ADB supports four bidding procedures:
- Single-Stage: One-Envelope
- Single-Stage: Two-Envelope
- Two-Stage: Two-Envelope
- Two-Stage
Single-Stage: One-Envelope Bidding Procedure
In the Single-Stage:One-Envelope bidding procedure, Bidders submit Bids in one envelope containing both the Price Proposal and the Technical Proposal.
The envelopes are opened in public at the date and time advised in the Bidding Document. The Bids are evaluated, and following approval by the ADB, the Contract is awarded to the Bidder whose Bid has been determined to be the lowest evaluated substantially responsive Bid.
Single-Stage: Two-Envelope Bidding Procedure
In the Single-Stage:Two-Envelope bidding procedure, Bidders submit two sealed envelopes simultaneously, one containing the Technical Proposal and the other the Price Proposal, enclosed together in an outer single envelope.
Initially, only the Technical Proposals are opened at the date and time advised in the Bidding Document. The Price Proposals remain sealed and are held in custody by the Purchaser. The Technical Proposals are evaluated by the Purchaser. No amendments or changes to the Technical Proposals are permitted.
The objective of the exercise is to allow the Purchaser to evaluate the Technical Proposals without reference to price. Bids of Bidders who do not conform to the specified requirements may be rejected as deficient Bids, with ADB’s approval.
Following ADB approval of the technical evaluation, and at a date and time advised by the Purchaser, the Price Proposals are opened in public. The Price Proposals are evaluated, and following ADB’s approval of the price evaluation, the Contract is awarded to the Bidder whose Bid has been determined to be the lowest evaluated substantially responsive Bid.
Two-Stage: Two-Envelope Bidding Procedure
In the Two-Stage:Two-Envelope bidding procedure, at the first stage, Bidders submit two sealed envelopes simultaneously, one containing the Technical Proposal and the other the Price Proposal, enclosed together in an outer single envelope.
Only the Technical Proposals are opened at the date and time advised in the Bidding Document, and the Price Proposals remain sealed and are held in custody by the Purchaser. The Technical Proposals are evaluated and if the Purchaser requires amendments or changes to the Technical Proposals, such amendments and changes are discussed with the Bidders. The Bidders are allowed to revise or adjust their Technical Proposals to meet the requirements of the Purchaser.
The objective of the exercise is to ensure that all Technical Proposals conform to the same acceptable technical standard and meet the technical solution required by the Purchaser. Bids of Bidders who are unable or unwilling to bring their Technical Proposals to conform to the acceptable technical standard will be rejected as deficient Bids with ADB’s approval.
Following ADB approval of the evaluation of Technical Proposals, Bidders are invited, at the second stage, to submit Modified Bid Proposals consisting of Revised Technical Proposals and Supplementary Price Proposals based on the technical standard agreed.
The original Price Proposals and the Modified Bid Proposals are opened at a date and time advised by the Purchaser. In setting the date the Purchaser will allow sufficient time for the Bidders to incorporate the changes in the Revised Technical Proposals that are needed to meet the agreed technical standard and to prepare the Supplementary Price Proposals that reflect these changes.
The Price Proposals, Supplementary Price Proposals, and Revised Technical Proposals are evaluated, and following ADB’s approval, the Contract is awarded to the Bidder whose Bid is determined to be the lowest evaluated substantially responsive Bid.
Two-Stage Bidding Procedure
In the Two-Stage bidding procedure, Bidders first submit their Technical Proposals, in accordance with the specifications, but without prices.
The Technical Proposals are opened at the date and time advised in the Bidding Document. The Technical Proposals are evaluated and discussed with the Bidders.
Any deficiencies, extraneous provisions and unsatisfactory technical features are pointed out to the Bidders whose comments are carefully evaluated. The Bidders are allowed to revise or adjust their Technical Proposals to meet the requirements of the Purchaser.
The objective of the exercise is to ensure that all Technical Proposals conform to the same acceptable technical standard and meet the technical solution required by the Purchaser. Bids of Bidders who are unable or unwilling to bring their bids to conform to the acceptable technical standard may be rejected as deficient bids.
After the evaluation of Technical Proposals has been approved by ADB, the second stage is to invite Bidders to submit Price Proposals and Revised Technical Proposals in compliance with the acceptable technical standard. The Revised Technical Proposals and Price Proposals are opened in public at a date and time advised by the Purchaser.
In setting the date the Purchaser should allow sufficient time for Bidders to incorporate the changes involved in the Technical Proposals and prepare Price Proposals.
The Price Proposals and Revised Technical Proposals are evaluated, and following ADB’s approval, the Contract is awarded to the Bidder whose Bid has been determined to be the lowest evaluated substantially responsive Bid.

Permen PU No. 43 Tahun 2007
Buat pembaca yang ingin mengetahui lebih jauh mengenai terbitnya Permen PU No. 43 tahun 2007 yang menggantikan Kepmen PU No. 257 Tahun 2004 yang dipakai sebagai acuan procurement di Dep. Peraturan Menteri Pekerjaan Umum No. 43/PRT/M/2007 tentang Standar dan Pedoman Pengadaan Jasa Konstruksi merupakan perubahan dari Keputusan Menteri Permukiman dan Prasarana Wilayah No. 257/KPTS/M/2004 tentang Standar dan Pedoman Pengadaan Jasa Konstruksi.
Peraturan ini meliputi :
a. Jasa Pemborongan terdiri atas :
Buku 1 : Standar Dokumen Pelelangan Nasional Pekerjaan Jasa Pelaksanaan Konstruksi (Pemborongan) untuk Kontrak Harga Satuan.
Buku 2 : Standar Dokumen Pelelangan Nasional Pekerjaan Jasa Pelaksanaan Konstruksi ( Pemborongan) untuk KOntrak Lump Sum.
Buku 3 : Pedoman Penilaian Kualifikasi Pelelangan nasional Pekerjaan Jasa Pelaksanaan Konstruksi ( Pemborongan)
Buku 4 : Pedoman Evaluasi Penawaran Pelelangan Nasional Pekerjaan Jasa Pelaksanaan Konstruksi (Pemborongan) untuk Kontrak Harga Satuan
Buku 5 : Pedoman Evaluasi Penawaran Pelangan Nasional Pekerjaan Jasa Pelaksanaan Kontruksi ( Pemborongan) untuk Kontrak Lump Sum
b. Jasa Konsultansi terdiri dari :
Buku 6 : Standar Dokumen Seleksi Nasional Pekerjaan Jasa Konsultansi Kontrak Berdasarkan Waktu Penugasan/Time Based ( Kontrak Harga Satuan)
Buku 7 : Standar Dokumen Seleksi Nasional Pekerjaan Jasa Konsultansi Kontrak Lump Sum.
Buku 8 : Pedoman Penilaian Kualifikasi Nasional Pekerjaan Jasa Konsultansi
Buku 9 : Pedoman Evaluasi Penawaran Seleksi Nasional Pekerjaan Jasa Konsultansi.

Guidelines for Procurement
Ketika teman-teman mulai terjun ke dunia Procurement dan Contract Management, tiba-tiba teman-teman akan mulai sering mendengar istilah tersebut di atas (aneh kan………., mungkin sebagian baru berpikir “kok saya baru tahu ya……?”, sebagian lagi mungkin berpikir “Wah ternyata ada guidelinesnya, seharusnya kan proses tendernya ok2 saja”).
Ya….berbagai macam komentar dan pikiran akan terlontar.
Singkat kata, saya akan mulai membahas mengenai beberapa Guidelines yang sering digunakan dalam Procurement dan Contract di beberapa Proyek di Indonesia , antara lain :
- Guidelines for Procurement World Bank Project
- Guidelines for Procurement ADB Project
- Guidelines for Procurement JBIC Project
- Guidelines for Procurement European Commission Project
- Guidelines for Procurement UNDP Project
- Keppres No. 80 Tahun 2003 beserta lanjutannya.
Memang untuk memahami betul-betul penerapan Guidelines tersebut kita harus benar-benar mengalaminya dan menggunakannya di proyek-proyek kita. Barulah kita tahu benar-benar perbedaan esensial antara masing-masing Guidelines tersebut.
Hal itu sangat menarik, meskipun semua guidelines tersebut bertujuan baik, namun tetap kita bisa menemukan hal-hal prinsip yang berbeda.
Saya berharap nantinya bisa memberikan pengalaman untuk teman-teman yang belum pernah tahu, dan sharing pengalaman bagi sesama Procurement and Contract Specialis.

Hukum Kontrak Konstruksi
Tentunya semua pembaca sepakat, bila saat ini saya minta pembaca untuk mencari buku yang bisa menjelaskan Kontrak Konstruksi versi Indonesia di toko buku, mungkin bisa berjam-jam mengubek-ubek toko buku tapi tidak menemukannya. Biasanya hanya berupa sub bab dalam satu buku.
Saat ini mulai sering diadakan pelatihan Hukum Kontrak, namun nampaknya baru Dep. PU yang mulai banyak mengadakannya. Itupun masih sebatas kepada Pengguna Barang / Jasa alias PNS, buat pembaca yang swasta ya harap sabar menanti…………….(menunggu godot mbayarin training swasta…………, just joking.).
Kebetulan saya memiliki beberapa file tentang training tersebut, jika saya berikan dalam bentuk file aslinya nanti saya dikira membajak, bila saya berikan hasil karya saya nanti orang akan berpikir apakah anda sudah berpengalaman, bila tidak saya berikan maka sayang sekali ilmu sebaik itu tidak disebarluaskan (memangnya The Secret yang disimpan beribu tahun…..?); setelah itu saya memutuskan untuk sedikit meluangkan waktu (memang harus capek sedikit….) merapikan presentasi-presentasi tersebut ke dalam file-file baru dengan tetap mencantumkan nama presenternya sebagai apresiasi kepada Beliau.

Masukan yang sangat bagus, akan segera saya tindak lanjuti.
Memang sangat sulit memperoleh informasi tentang training berkaitan dengan Contract Management di Indonesia.
